Liability Waiver & Release Agreement

I. ASSUMPTION OF RISK

I understand that participation in meal preparation classes and cooking activities offered by Meal Prep Parties, LLC involves certain inherent risks, including but not limited to:

  • Cuts, burns, slips, falls, and other kitchen-related injuries

  • Injuries resulting from the use of knives, appliances, and cooking equipment

  • Exposure to food allergens up to and including anaphylaxis or death

  • Foodborne illness

  • Physical exertion associated with cooking and food preparation

I understand that I am responsible for the proper transportation, refrigeration, freezing, reheating, and consumption of any meals or food products prepared during the class after they leave the event location. Meal Prep Parties, LLC is not responsible for food spoilage, improper storage, or foodborne illness resulting from food handling after participants leave the class.

​I knowingly and voluntarily assume all such risks, whether or not described above, and accept full responsibility for using reasonable judgment and following the instructor’s safety directions during all phases of the class. I affirm I am physically able to participate or have obtained clearance to do so.

II. FOOD ALLERGEN ACKNOWLEDGEMENT, DIETARY RESTRICTIONS & DUTY TO DISCLOSE

I understand that meal preparation activities may involve common allergens, including but not limited to: milk, eggs, wheat, soy, peanuts, tree nuts, fish & shellfish. Because the program is a shared, hands-on environment using shared equipment, surfaces and ingredients,  I acknowledge that Meal Prep Parties, LLC cannot guarantee an allergen-free environment and that cross-contact may occur even when an allergen-free or modified option is requested. 

It is my responsibility to disclose any food allergies or dietary/medical restrictions in writing and before the session to the host and to determine whether participation is appropriate for me. Participants will take all precautions appropriate including carrying any necessary emergency medication (ex. EpiPen)​

III. RELEASE & WAIVER OF LIABILITY

To the fullest extent permitted by law, in consideration of being permitted to participate, I release, waives, discharges and agree not to sue Meal Prep Parties, LLC, its owners, employees, contractors, instructors, volunteers, and event venues from any claims, demands, actions, causes of action, costs, expenses, or damages for property damage, personal injury, illness, allergic reaction, or death that arise out or related to my participation including claims based on the ordinary negligence of Meal Prep Parties LLC. 

This release does not apply to liability caused by the gross negligence or willful misconduct of Meal Prep Parties, LLC and does not waive any right that cannot be waived under Arkansas law. If any portions of this release is held unenforceable, the remainder stays in effect. ​

IV. INDEMNIFICATION

I agree to indemnify, defend and hold harmless Meal Prep Parties, LLC from any claims, damages, losses, costs and expenses (including attorney fees) brought by myself, guest, minor or third party I bring or register arising out of or related to 1) failure to disclose an allergy, restriction or condition 2) my own or guest's acts or omissions 3) my breach of this Agreement​

V. MINOR PARTICIPANTS (CHILDREN) AUTHORIZATION

This section applies when a participant is under 18 (a “Minor”). A parent or legal guardian must sign for each Minor and accepts the following terms:

  • Supervision: A parent or guardian must remain on the premises and supervise the Minor at all times during the class, unless Meal Prep Parties LLC agrees in writing to a drop-off format with adequate staffing.

  • Disclosure for the Minor: The parent/guardian is responsible for disclosing the Minor’s allergies, restrictions, and medical conditions, and for providing any emergency medication.

  • Release on Behalf of the Minor: To the fullest extent permitted by Arkansas law, the parent/guardian assumes the risks described in this Agreement on the Minor’s behalf and releases and agrees to indemnify Meal Prep Parties, LLC as described in Sections above individually and on behalf of the Minor.​

VI. ADDITIONAL TERMS

​A. Medical Emergencies

I authorize Meal Prep Parties, LLC in a perceived emergency, to call 911 or summon

medical assistance. I accept full responsibility for the cost of any medical treatment. Meal Prep Parties, LLC is not responsible for providing medical care.

 

B. Limitation of Liability

To the fullest extent permitted by law, Meal Prep Parties LLC will not be liable for indirect,

incidental, special, or consequential damages. If liability is nonetheless imposed, it will not

exceed the amount I paid for the session giving rise to the claim, except in cases

of gross negligence or willful misconduct.

 

C. Governing Law & Venue

This Agreement is governed by the laws of the State of Arkansas. I agree that any

dispute will be resolved in the state courts located in Washington County, Arkansas.

 

E. Severability & Entire Agreement

If any provision is found void or unenforceable, the remaining provisions stay in effect. This

Agreement is the entire agreement between myself and Meal Prep Parties, LLC and may be

modified only in a writing signed by both Parties.
